1 - WILLINGNESS TO APPLY THE CRPD.
Do you feel that the political and administrative authorities of your country are strongly committed to/involved in fully implementing the CRPD?

Even though the CRPD was ratified in 2009, political and administrative authorities just recently started cooperating with NGOs/DPOs in its implementation.

 

2 - FOCAL POINTS.
Have the focal points (i.e. points of contact) provided for in article 33-1 of the CRPD been designated in your country?

Focal points in Montenegro are still not designated. In the Ministry of Labour and social welfare is just one person who is in charge for all issues related to people with disabilities, which includes also monitoring and implementation of the CRPD.

 

3 - ROLE.

What is, or will be, their role?

Based on our information there is no legal document which is defining role of focal points.

 

4 - COORDINATION OF ACTIONS FOR THE IMPLEMENTATION OF THE CRDP AND FOCAL POINTS.
How are the focal points and the actions for the CRPD's implementation coordinated?

5 - PROMOTION OF THE CRPD.
How does your country go about promoting the CRPD?

Based on our information no promotional campaigns with the concrete goal to promote the implementation of the CRPD have been organized.

 

6 - PROTECTION OF THE RIGHTS INCLUDED IN THE CRPD.
Which national authority is responsible for ensuring the effective implementation of the rights included in the CRPD?

The national authority responsible for ensuring the effective implementation of the rights included in the CRPD is Ministry of labour and social welfare.

 

7 - MONITORING OF THE IMPLEMENTATION OF THE CRPD.
In your country, which authority is in charge of monitoring the implementation of the CRPD?

The Ministry of labour and social welfare is in charge of monitoring the implementation of the CRPD.

 

8 - ROLE OF ASSOCIATIONS OF BLIND OR VISUALLY IMPAIRED PERSONS. How are the associations of blind or visually impaired persons involved in the implementation of the CRPD?

DPOs are participating in working groups which are preparing national legislation and through that work they are contributing to the goal that all the legal documents are in line with CRPD.  Also they are implementing different projects, financed by different donors where the main goal is implementation of the CRPD.

 

9 - ADDITIONAL RESOURCES.
Have any additional resources (human or financial) been been made available for the implementation of the CRPD?

In Montenegro we don't have funds which are dedicated to implementation of the CRPD.  Nor is there any special national body with the task just to work on implementation of the CRPD.

 

10 - CRPD IMPLEMENTATION MONITORING REPORT.
Depending on the date on which your country ratified the CRPD, is it required to submit a report to the UN Committee on the Rights of Persons with Disabilities? If it is, has it done so?

Although the country had the obligation to submit an initial report during 2011, this report was prepared only in December 2013 and adopted by the Government on their first meeting in 2014.  Representatives of DPOs didn't participate in the process of preparation of the report because the state decided to involve just 3 representatives from DPOs instead of 16, and it was not enough for equal participation of all the NGO sector.

 

11 - SHADOW REPORT.
Have the associations of persons with disabilities presented the so-called shadow report?

Some of the DPOs have prepared a number of documents which will be used for drafting the shadow report. The shadow report is in drafting phase and is still not finished.
